Welcome to Karda Pty Ltd. Please read the following terms and conditions applicable to the use of products and services provided by www.davidstewart.net.au (hereafter called “this website”). The following terms and conditions govern the use of this website and constitute an agreement between the contracting parties. By browsing this website or placing an order, the customer agrees to be bound by the terms and conditions listed below. Karda Pty Ltd reserves the right to update and amend the terms and conditions at any time without notice. It is therefore advised that the customer reviews the terms and conditions prior to each purchase made via this website. Karda Pty Ltd recognizes the importance of protecting the privacy of personally identifiable information collected about our customers and is committed to complying with all applicable legislation governing privacy in NSW and Australia, namely the Privacy and Personal Information Protection Act 1998 NSW (hereafter known as “the Act”). Karda Pty Ltd collects several different types of information from our customers to make their shopping and browsing experience more enjoyable.

If a customer (registered or non-registered) elects to pay online using a credit card, those card details are not viewed by Karda Pty Ltd or any other party at any time during the transaction. Credit card details are encrypted and sent directly to the bank through our secure payment gateway. Credit card details are not retained under any circumstances.

General site traffic data (non-personal) is collected for the purpose of improving our products and services. Non-personal information does not identify individual users. Such statistical data is analysed for research, advertising or marketing purposes to allow us to understand the sorts of products our customers are interested in and assist us in improving content and providing site maintenance.

Karda Pty Ltd will not share customers’ personal information with any third party, unless it is expressly for the purpose of contacting a customer (i.e. shipping products). If a customer is contacted by a third party naming us as the point of reference, we ask that they contact us immediately and will take appropriate action on the customer’s behalf.

While Karda Pty Ltd takes all due care and implements the abovementioned security measures for this website, customers should understand that, unfortunately, 100% security cannot be guaranteed.

Customers are individually responsible for the security of and access to their own computer. Customers are solely responsible for maintaining the secrecy of their username, passwords and any account information. Customers should ensure they logout at the end of every session, particularly if using a shared computer.

1.3 Cookies

Cookies are used to transmit information between this website and a customer’s computer. For example, cookies help our shopping system register and remember products that are placed in a customer’s shopping bag. Customers may disable cookies, however doing so will prevent customers from using some sections of this website, including the shopping bag system and member’s area.

2. Capacity to Contract

Orders can only be placed by customers with the capacity to contract who are over the age of 18 or 21 as legislated in your state of residence.

3. Product Orders and Methods of Payment

All product orders placed through this website www.davidstewart.net.au are processed through the PayPal online banking system whereby a credit card is required to make a legitimate purchase.

4. Shipping and Handling

We offer a flat rate of $10 postage to any destination in Australia. Delivery is via Australia Post and is generally between 5-7 working days. Products will not be shipped until payment is received in full. This includes waiting until cheque funds or money orders have been cleared, if that is the preferred method of payment.

5. Refund and Return Policy

Refunds will only be accepted for faulty products (excluding shipping and handling). Faulty products can be returned by mail to:

Exchanges will be accepted for damaged goods (excluding shipping and handling). Damaged products can be returned by mail to the above address.

Refunds and exchanges will not be accepted if a customer simply changes their mind.

6. Backorders

If Karda Pty Ltd is unable to complete a customer’s order due to a product shortage, we will contact the customer within three working days to arrange alternative arrangements. If the customer elects to place the product on backorder, they will be advised when the product arrives to ensure they still want the product.

7. Pricing and Taxes

All prices are quoted in Australian dollars. Prices quoted on the website include GST. Order details will show product prices excluding and including GST.

8. Termination of Account

Karda Pty Ltd or the customer may suspend or terminate a customer’s account or use of this website at any time, for any or no reason. The customer is personally liable for all orders placed or charges incurred prior to termination.

9. Accuracy of Information

Karda Pty Ltd has attempted to ensure all information contained on this website is complete, current and accurate. However, information on this website may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currency of information provided on this website. For example, products advertised on this website may be unavailable or have attributes different to those listed. All features, content, specifications, products and prices of products are subject to change without notice.

Any advice or information contained within this website (including, but not limited to product recommendations) is of a general nature and is not intended to constitute or replace professional advice for individual customers or for specific conditions.
